SMA Minor Construction

New BMPs as designed in the SMA Minor permit were put in place before any sitework commenced. At the direction of the DPP inspector we have removed BMPs where the construction is complete and the grass is in place. The construction of the SMA Minor is completed and awaiting final inspection. The final electrical work has been completed and we are awaiting a final inspection from HECO and DPP to close out the permit and remove all remaining BMPs. Signs were posted facing both inside and outside the property directing pedestrians to use the crosswalk at Pupukea Road. The Pahoe Road fence was completed on August 19th, 2021.

Tenant Compliance

All trucks completed their required two moves in April. Single-use plastics, plastic straws, and non-reef-safe sunscreen continue to be prohibited for all tenants. Tour buses continue to be prohibited from the site. All tenants have been notified to remind customers to use the crosswalk at Pupukea Road when crossing Kamehameha Highway. Any signs within 30 feet of the highway have been removed.

Baseline Inspection Report and Compliance

Inspectors from DPP visited the property unannounced in February 2021 and conducted a baseline inspection of the entire property. Hanapohaku and others received the report on February 23rd, 2021. Hanapohaku has since reviewed the report including the photos and required changes described in it. All tents required to be removed were immediately taken down. The signs included in the report have all been removed. The electrical violations have been addressed and are awaiting a final inspection at the completion of the SMA minor construction.

Aloha, On the occasions when music is being played at your development by one of your tenants, the music is so loud that it can be clearly heard over 500' away up the hill. Per the settlement agreement the sound level is not allowed and violates the agreement.

John - Thanks for alerting us to the issue. We will follow up with the tenants and confirm that everyone is in compliance with federal, state, and city laws regarding noise per the settlement agreement. If you can provide specific times or dates when this occurred it will make it easier to identify and solve the issue.

Aloha, I am writing to you about a few issues that have been on my mind for a while. 1/ The ongoing safety issues of people crossing Kam Highway in front of your food truck establishments. Perhaps signage at the entrance/exit could direct people to use the crosswalk at the intersection, remind pedestrians of the fines for illegal crossing and how dangerous and inconvenient is is to have people walking all over the road. 2/ The amount of litter from your food trucks that ends up across the road in the Sharks Cove park. Someone from 808 Cleanups regularly picks up trash across the road from your food trucks. A lot of the litter and overflowing trash can contents comprise of waste from your food trucks. This has been verified not just because of visual similarity to what is being served on your property but there are receipts too. 3/ Selling "Snorkel Tours" and providing people (who often cannot even swim) "reef walking" shoes with which they proceed to walk, stand and trample the coral in Sharks Cove. Please stop this and provide better reef etiquette / education to the people on your property. 4/ The plants that are supposed to provide a visual barrier along the road are dying/dead and no longer providing a barrier. Please rectify this problem. Mahalo for your kind attention to these matters.

Hi Angela - Below are answers to your concerns.

1 - We will ensure that signage is placed at the entry that directs people to use the crosswalk and we will remind all tenants to inform customers about the fines and danger of crossing illegally.

2 - We will also remind our tenants to mention to customers to use the provided trash receptacles on our property. We likewise deal with folks bringing trash onto site and have recently added additional trash cans/boxes with wooden lids.

3 - We will check with the surf shop to ensure that they are providing proper education for any customers buying or renting snorkel gear.

4 - The plantings in the box sometimes go through natural cycles. Some of the kalo was harvested and we are currently working to plant additional plants into the boxes to ensure that we are in compliance with the 1.5' height required in the settlement agreement.

We live on the street next to all the food trucks. The trash truck comes at 3:30 in the morning during the week and the pumping truck comes at five. Can you let these companies know they are coming way too early? Thank you

Hi Jim - Just following up. We have confirmed with all trash, pumping and delivery vehicles that they are not supposed to be on site before 7:00am. Please do let us know in the future if you notice this not being followed.
