SMA Minor Construction

Continuous abutting planter boxes along Kamehameha Highway have been constructed, filled, and planted with native plants. Planter boxes along Pahoe Road have been moved to create a continuous buffer with 6’ tall vegetation. The boxes will be moved to connect with the recently completed fence.

New BMPs as designed in the SMA Minor permit were put in place before any sitework commenced.

The chain link fence along Pahoe Road was accurately located by a licensed surveyor according to the layout in the approved SMA Minor permit and construction was completed on March 28, 2021.

Sitework for the SMA Minor full buildout has begun, starting on the mauka side of the property. Special care was taken to avoid any grading work  during heavy rainstorms.

Tenant Compliance

All trucks completed their required two moves in March with some being off site for multiple days. Single-use plastics, plastic straws, and non-reef-safe sunscreen continue to be prohibited for all tenants. Tour buses continue to be prohibited from the site. Any signs within 30 feet of the highway have been removed.

Baseline Inspection Report and Compliance

Inspectors from DPP visited the property unannounced in February, and conducted a baseline inspection of the entire property. Hanapohaku and others received the report on February 23rd. Hanapohaku has since reviewed the report including the photos and required changes described in it. All tents required to be removed were immediately taken down. The signs included in the report have all been removed. The electrical violations will be addressed safely as Hanapohaku engages with a licensed electrical contractor for the SMA minor construction. Any violations not requiring a licensed electrician were corrected immediately. All of the trucks were required to get updated safety checks and registrations. As of April 1st, all trucks operating on the land are up to date. We have requested DPP to remove the NOVs for all the corrected work. On March 5th, a check for $30,000 was submitted to DPP in full and complete settlement of all outstanding fines issued against Hanapohaku LLC, as provided in Section 23 of the settlement agreement. On March 17 Hanapohaku paid a $500 fine to DOH for failure to update the stormwater BMPs. These were replaced before any construction started on the SMA minor and the violation was cleared on March 22.

All Hotline inquiries have been posted to the website. There was one formal inquiry lodged on the website in the last month with several follow up emails. Communication thread with responses posted below. A monthly update with all required information was posted to the website on March 31, 2021.

Name: John Thielst - Hello, I see work is beginning along Pahoe rd. As surveying is being done would like to mention that the Pahoe road is 40' wide. I would upload a copy of the document but the Hotline is not set up for it. Might be a good idea to be able to attached documents here. Any way this information Pahoe rd width can be found at Dept of Budget and Fiscal Services Real Property Assessment Division. Would be happy to send they document when you make it possible on this site to do so. This being said the current planter boxes and palms along the road could possibly be inside the 40' width. I'm sure the survey will show this. Thank you

Response Dear Mr. Thielst, - Your statement has been noted.  Currently a professional survey is being done prior to the fence line or any other work being done.  Once the survey is complete we will confirm where the proper location should be.  We moved the planter boxes prior to survey as a courtesy to the neighbors and community to show good faith in the current settlement. Name: John Thielst - Hi, Question: Is the chain link fence right on the property line or 3' inside the line to allow for the 3' vegetation buffer to be out to the property line?

Dear Mr Thielst - The fence has been strictly measured by two separate surveyors to hit the exact positioning of the allowed SMA MINOR. As per the Approved SMA Minor this will allow for vegetation on the outside of the fence within the property line as outlined in the SMA Minor. Regards, HanaPohaku LLC
