SMA Minor Construction

New BMPs as designed in the SMA Minor permit were put in place before any sitework commenced. At the direction of the DPP inspector we have removed BMPs where the construction is complete and the grass is in place. The construction of the SMA Minor is completed and awaiting final inspection. The grading permit was closed on July 18, 2022. The final electrical work has been completed and we are awaiting a final inspection from HECO and DPP to close out the permit. Signs were posted facing both inside and outside the property directing pedestrians to use the crosswalk at Pupukea Road. The Pahoe Road fence was completed on August 19th, 2021.

Tenant Compliance

All trucks completed their required two moves in May. Single-use plastics, plastic straws, and non-reef-safe sunscreen continue to be prohibited for all tenants. Tour buses continue to be prohibited from the site. All tenants have been notified to remind customers to use the crosswalk at Pupukea Road when crossing Kamehameha Highway. Any signs within 30 feet of the highway have been removed.

Baseline Inspection Report and Compliance

Inspectors from DPP visited the property unannounced in February 2021 and conducted a baseline inspection of the entire property. Hanapohaku and others received the report on February 23rd, 2021. Hanapohaku has since reviewed the report including the photos and required changes described in it. All tents required to be removed were immediately taken down. The signs included in the report have all been removed. The electrical violations have been addressed and are awaiting a final inspection at the completion of the SMA minor construction.

From the Mutual Settlement Agreement: “4. Information Sharing. Developer agrees to post accurate information, updated at least monthly, on its website regarding any updates to all aspects of its permitting and compliance process, including penalties assessed and fines paid, and anticipated tenant mix.” According to former DPP Director, Dean Uchida, DPP rejected preliminary building plans for the Rural Community Commercial Center in August and October of 2021. 2 questions: Why were the plans rejected ? Was this information ever posted on your website ?

Hi Larry - We are not aware that "DPP rejected preliminary building plans" in 2021. Please do share any correspondence or documents from the director that describe this and we can respond to that information.

Saturday 5/20 4:30 pm very loud Drumming music coming from your area by one on your Tenants. It can clear be heard over 600’ away. You say you inform your tenants but they don’t seem to listen to you. The Taco sign is also still in violation of the agreement. When is it coming down?

Hi John - We were alerted to this noise as well. There was a loud drum circle in the park across the street at the basketball courts that started around 4:00pm. We would never allow this kind of drumming at our property. 

Regarding any signs, we continue to be in full compliance with all laws and the settlement agreement. This has been verified previously but we are happy to discuss in mediation at any point.

When will planter boxes be corrected as they’re big gaps between plants and not blocking view? Currently not in compliance.

Once again, people are complaining about your tenant’s loud and obnoxious PA system. It can easily be heard in the public park across the highway for hours on end. Please address this issue once and for all so you can get back in compliance with the MSA. Thank you.

Hi Larry - We immediately looked into this as soon as we received your email and confirmed that there is no PA system on our property. It was a busy holiday weekend so there could have been music coming from the park or a vehicle. We have consistently required our tenants to not play any loud music and will continue to check into any complaint we receive to confirm that we are in compliance.

Sound is being amplified through a speaker of some sort (commonly called a PA system) in order to inform your tenants customers that their orders are ready to be picked up. It appears to be coming from North Shore Tacos. This loud, obnoxious noise goes on for hours on end and is clearly audible in the public park across the highway and beyond.

Hi Larry - We will just respond once to your four most recent messages. Thanks for clarifying what sound you were referring to in your original message. This is the first time we've received a comment about the ordering system for North Shore Tacos so it was not initially obvious what the original comment was referring to. We have reached out to North Shore Tacos and they offered to turn down the volume on their order notifications. We will pass along the suggestion about considering other technologies as well.
