SMA Minor Construction

New BMPs as designed in the SMA Minor permit were put in place before any sitework commenced. The grading permit was closed on July 18, 2022. The electrical permit was closed on June 21, 2023 and the overall permit closed on June 30, 2023 after a final inspection by DPP and HECO. Signs were posted facing both inside and outside the property directing pedestrians to use the crosswalk at Pupukea Road. The Pahoe Road fence was completed on August 19th, 2021.

Tenant Compliance

All trucks completed their required two moves in November. Single-use plastics, plastic straws, and non-reef-safe sunscreen continue to be prohibited for all tenants. Tour buses continue to be prohibited from the site. All tenants have been notified to remind customers to use the crosswalk at Pupukea Road when crossing Kamehameha Highway. Any signs within 30 feet of the highway have been removed.

Baseline Inspection Report and Compliance

Inspectors from DPP visited the property unannounced in February 2021 and conducted a baseline inspection of the entire property. Hanapohaku and others received the report on February 23rd, 2021. Hanapohaku has since reviewed the report including the photos and required changes described in it. All tents required to be removed were immediately taken down. The signs included in the report have all been removed.

Permitting

Hanapohaku received a two-year extension to its SMA Major permit.

Website Information

All Hotline inquiries have been posted to the website. Communication thread with responses posted below. A monthly update with all required information was posted to the website on Nov. 30, 2023.

Hi Denise - We have confirmed compliance on our side. While we do not agree that any of these activities violate the settlement agreement we are always happy to engage in good faith exchanges and make adjustments if possible. The tenant agreed to take down the sign you mentioned and confirmed that they are always extremely careful and communicative with customers about ocean conditions and have not had any issues with safety.

Please have the one food truck in the far back left corner change there address as it shows a Pahoe rd address and obviously they can’t get there from Pahoe rd and it would eliminate undo traffic that has to turn around on Pahoe road to go back on Kam hwy and then into your property. Traffic is bad enough without adding confusion to the mix. Do your part to fix it.

Google maps etc.

Hi John - We tried Google Maps on both mobile and desktop and both show the address on Kamehameha Highway (see attached screenshots). We also checked Apple Maps and it is correct as well. Not sure if there are other sources you are thinking of. Any additional information you can share will be really helpful to solve the problem.

Probably the way the maps take people and they think they can get there from Pahoe rd as that’s the closest to it.

The Seven Brothers restaurant is not a "Food Truck" it's a 40' or so trailer with two (2) service windows. I'm pretty sure that's outside the MSA. Also how does it move twice a month and it looks very pertinent with the two front platforms, all the plants, at lease 4 gas tanks attached, and the supply water tank in the pick up truck. Would like to see and witness this and all the other actual food trucks departing the property twice monthly per the MSA as everyone seems in the exact spot with no movement.

Hi John - Per the settlement, all operators on the property are required to have their vehicle follow all Department of Health and city and state statutes, rules, ordinances and permits. All operators are in compliance regarding this. Regarding the trucks moving, we are in compliance with this as well. We continue to try to use this hotline to respond to complaints and we make every effort to adjust things if possible. If there are disagreements regarding interpretation of the settlement agreement we still think that will be best to resolve that through the mediation process outlined in the MSA.

Ok, so by stating that you are in compliance with the MSA as far as movement offsite twice a month per the MSA you guarantee and certify that the food truck are leaving the premises two times a month per the MSA?
