SMA Minor Construction

New BMPs as designed in the SMA Minor permit were put in place before any sitework commenced. The grading permit was closed on July 18, 2022. The electrical permit was closed on June 21, 2023 and the overall permit closed on June 30, 2023 after a final inspection by DPP and HECO. Signs were posted facing both inside and outside the property directing pedestrians to use the crosswalk at Pupukea Road. The Pahoe Road fence was completed on August 19th, 2021.

Tenant Compliance

All trucks completed their required two moves in September. Single-use plastics, plastic straws, and non-reef-safe sunscreen continue to be prohibited for all tenants. Tour buses continue to be prohibited from the site. All tenants have been notified to remind customers to use the crosswalk at Pupukea Road when crossing Kamehameha Highway. Any signs within 30 feet of the highway have been removed.

Baseline Inspection Report and Compliance

Inspectors from DPP visited the property unannounced in February 2021 and conducted a baseline inspection of the entire property. Hanapohaku and others received the report on February 23rd, 2021. Hanapohaku has since reviewed the report including the photos and required changes described in it. All tents required to be removed were immediately taken down. The signs included in the report have all been removed. The electrical violations have been addressed and are awaiting a final inspection at the completion of the SMA minor construction.

Baseline Inspection Report and Compliance

Hanapohaku is pursuing an extension to its SMA Major permit.

Please clean up the green silt erosion control socks along the Pahoe road side of your fence. The neighbors are trimming the trees and want to land scape the area. Socks have been all messed up for years and not doing anything really. Thank you for your attention to this request.

Hi John - We just notified the landscaping crew to remove any remaining erosion control socks on Pahoe Road. This should be done in the next couple weeks.

Are there any activities taking place on your property that cater primarily to visitors to the area ? For example: sales, rentals, lessons, entertainment, sight-seeing, parking and/or dining.

Hi Larry - Is there a specific complaint or issue you would like us to address? The activities on the site continue to follow the guidelines set out in the North Shore Sustainable Communities Plan: "The rural community commercial center is a small cluster of commercial and service businesses located on major thoroughfares that provide a range of goods and services to meet the needs of the surrounding residential communities. Located along highways and major thoroughfares, these centers also attract visitors and residents from outside the immediate community."

Hi Larry - Apologies if you are expecting a faster response. As stated on our website our intention is to always respond within 72 hours but we usually do so much faster than that.

Also, as stated in the settlement agreement, the hotline is "dedicated to receiving and recording complaints about its operations" and that "the developer is not required to publicly respond to any complaints that amount to "talk stink" (i.e. the complaint lacks merit or is otherwise not a bona fide good faith complaint." We have continually maintained a cordial tone and have responded and taken action when appropriate to all legitimate complaints. 

So while there is no specific complaint raised in your question, we will state again that the project has always had the goal to serve the surrounding community through goods, services, business and employment opportunities and it also may attract visitors and residents from outside the immediate community.

If this answer does not satisfy your inquiry we will again reiterate that we are happy to take up any of these issues in mediation as stipulated in the settlement agreement. The hotline is designed to respond and solve specific complaints but if larger issues require conversation, mediation would be much more appropriate.

If your plan is to regain the trust of this community, might I suggest that you provide comprehensive, accurate and timely information and less obfuscation.

By the way— your hotline / website doesn’t seem to be complete.  Are several monthly updates missing ?

Loud noise and strong odors emanating from Food Trucks onto public spaces. Today I observed the VERY loud "order ready" noise from the Taco Truck and VERY strong greasy/oily odors emanating from that and/or other food trucks while I was in the Pūpūkea Beach Park, more than 30 feet away across the Highway. Please (1) stop the noise - use a quiet system if you must notify customers, and (2) stop the odors - install additional fan/controls or change what is prepared. Both of these issues have been continuously or intermittently a nuisance for at least three years in my personal observations. In my view, the noise and odors violate City/State law as well as the settlement agreement Para 18 Nuisance. Please fix.

Hi Denise - We have reached out to the owner of the Taco truck and they have turned down the volume on their order system. This is the first time we have received a complaint about odors. We will double check to make sure that all systems are in full compliance as stipulated in the settlement agreement.

Thank you for the response on the loud "order" noise.

Regarding odors, I have heard that complaint from many community members, including from upwind along the pali of Pūpūkea, so I will urge those affected to submit a complaint to this hotline so you have a more complete picture of the concerns.
